New NCLB Guidance on Alternate Standards for Students with Disabilities


USDE's new non-regulatory guidance, Alternate Achievement Standards for Students with the Most Significant Cognitive Disabilities, provides States with detailed information about how best to use and implement alternate achievement standards. It also aims to ensure that schools and local education agencies receive credit for their achievement.

The development of alternate achievement standards for students with the most significant cognitive disabilities and their use for making adequate yearly progress (AYP) decisions is authorized under a Department regulation (34 C.F.R. Part 200) released on December 9, 2003. This guidance explains the provisions included in that December 2003 regulation. In particular, the document focuses on the Individualized Education Program teams (Section D); Alignment (Section E); the "One Percent Cap" (Sections F and H); the Exception Process (Section G), and Reporting (Section I).
